Apple legal has no recourse in a country it has no stores in but I think that they might complain about someone doing it in a country where they do have stores. (Where you can walk into any AT&T or Apple store and see it for yourself). I do not know what Apple legal would do, I'm just suggesting they might do something, not that they would. Critiscism, I'm guessing you mean the whole "only in India thing" well, that could be the case for any developing nation, I suppose but this happens to take place in India and the folks in China have their own iPhone knock-off and I don't hear about those offers coming out of any other country... Why do idiots in the US and other developed countries pay huge premiums on eBay etc to buy products when they are launched and are in short supply.
