Apple and HTC in battle over "Touch" trademark

By Jonathan Schlaffer

Untitled-1 Some of you may be aware of the existence of something called the HTC Touch which is a SmartPhone.  You’ll should also know that Apple just announced the iPod Touch which is due to ship by the end of this month.  Not everything is Kosher between Apple and HTC with HTC claiming they “own” the “touch” trademark.

Can’t these companies ever get along?  Why not just start trade marking every word in the English language and be done with it.  This is getting to the point of being ridiculous.

The iPod touch is an iPod that happens to have PDA functionality what with it’s Safari browser, WiFi connectivity and Contacts application.

The HTC Touch is a PDA with a phone but really lacks the sleek styling and experience that you will get with the iPod Touch.

In my opinion these cases should be ruled depending on which device is more attractive.  Compared to the iPod Touch the HTC Touch is kind of ugly but the same would apply to every other device on the planet as well.

Why pay $400 for a regular old PDA when you can get the much more functional iPod Touch.  Of course, if you need a phone, get a SmartPhone or the iPhone but I like keeping my media player/PDA separate from my phone and I do my best to stay off AT&T networks.

I agree! This laq suit is a total joke. I share your thoughts, why not just trademark every word in the english language and sew everybody?! ;-)

But to have a trademark on “touch” is just crazy, it’s going way to far.

I agree with the both of you that trademarking word s is a ridiculous approach but it happens all over the world. We’ve even had a recent struggle in Germany about a company that claims to own the trademark “Kinder” (as in kindergarden), meaning children. Bottom line: you can’t help stupid people. :-)

Where I don’t agree is that the HTC Touch is just a plain old PDA compared to the iPod Touch. The fact that the iPod Touch can only be used in a very limited way (only Wi-Fi, no Flash support, no email application) doesn’t make it a decent PDA replacement yet.

      Regards, Chris

Does anyone know how to register a trademark for a business with the USPTO? I’m struggling to find out exactly how to get the process started.
