RIAA Defendant Plans To Appeal $222,000 Ruling

By Sean P. Aune

RIAA Defendant Plans To Appeal $222,000 Ruling The woman who was fined $222,000 last week for music piracy, has announced she will be appealing the ruling.

Jammie Thomas and her attorney, Brian Toder, appeared on CNN today and announced that they will be appealing the ruling against her.  Ms. Thomas was fined $9,250 per song for music she had in her sharing folder on the KaZzA network.

Ms. Thomas will be basing her appeal on the 15th instruction to the jury which stated that she could be found guilty for merely making the files available, but without any proof that any of them were actually transferred.

As with any trial process, it could be quite a while before this actually gets to the courts, if her appeal is even accepted.  Then, if the appeal is granted, both sides have to decide if they wish to go through the process again, in addition to the legal fees.

This story is a long way from being concluded.
