Creative’s MP3 player capacity class action lawsuit finally settled

Creative's MP3 player capacity class action lawsuit finally settled Apparently not everyone owns or uses an iPod; some of you choose to use Zunes or even a Creative Zen.  In the case of Creative’s players it seems that the company exaggerated storage capacities so even though free space was indicated there was none.  Affected users will be able to get discounts from Creative’s online store.

There’s nothing so great in the discount offers.  If you own a Creative MP3 player manufacture between May 5, 2001 and April 30, 2008 then you could be entitled to a class action settlement but don’t expect to be getting something for free.

You will be offered a 50% discount on a new 1GB player or 20% off any other item purchased through Creative’s online store.  According to Engadget, applications are due by August 7, 2008.  I can’t confirm those discounts because the claim form is pretty generic offering two options,

Discount Player Benefit

To receive the Discount Player Benefit, your purchase must have occurred prior to January 1, 2004 AND you must provide Proof of Purchase (store receipt, credit card statement or bank statement) that shows ALL the “Purchase Information” below.

If you are deemed ineligible for the Discount Player Benefit due to a deficiency in your Proof of Purchase, check here if you wish to receive the Discount Certificate Benefit instead. IF YOU DO NOT CHECK THIS BOX, YOU WILL NOT RECEIVE THE DISCOUNT CERTIFICATE BENEFIT:
You must submit the Proof of Purchase on the next step.

Discount Certificate Benefit

To receive the Discount Certificate Benefit, you must (1) enclose with this form a Proof of Purchase (store receipt, credit card statement or bank statement) that shows ALL the “Purchase Information” below OR (2) provide on this form all the “Purchase Information” below and the serial number of the Creative HDD MP3 Player you purchased.

It would be nice if the form were more specific but it is what it is.
