Message on Twitter leads to lawsuit

Message on Twitter leads to lawsuit It seems you need to be careful of what you say on your Twitter account or you might just find yourself being sued.

Amanda Bonnen of Chicago sent out a Tweet, slang for the short messages used on Twitter, back on May 12 that has landed her in some hot water legally.  In the message she sent she made reference to the fact that there was mold in her apartment, a claim that is denied by the management company, Horizon Group Management LLC.

The message read:

Who said sleeping in a moldy apartment was bad for you? Horizon realty thinks it’s okay.

She was referring to an apartment that she has since moved from that is located at 4242 N. Sheridan in Chicago.

According to the Chicago Sun-Times, Horizon Group Management LLC has now filed a lawsuit in Cook County Circuit Court, and is seeking $50,000 in damages.  The suit claims that Ms. Bonnen ”maliciously and wrongfully” accused the company.  Jeffrey Michael, whose family has run the company for over 25 years, was asked if they had spoken with the former tenant yet about the situation, he replied that they had not, and he added, “we’re a sue first, ask questions later kind of an organization.”

Duncan Riley of The Inquisitr found that the Twitter account has since been deleted, but he located a screenshot of her account in the Google Cache system.  In a screenshot he posted, it showed that Ms. Bonnen had 22 followers at the time of her comment.  As Mr. Riley aptly put it:

I think someone needs to talk to Horizon about the Streisand effect pretty quickly, because that 22 people could end up being 22 million once news of their ridiculous suit spreads.

While companies have every right to protect themselves, this story has now gone much further than it ever would have if no lawsuit had been filed. Now that legal action has been taken, mold or not, the company has shown themselves to not be very tenant friendly.

The lawsuit will fail for the defendants if they bother to gather even one speck of mold anywhere in said apartment and demostrate to the court that it was indeed infested with mold. The definition of “moldy” does not specify any particular quantity of mold, AFAIK…
