Microsoft sues Tivo to help AT&T, playground style

Microsoft is suing TiVo over alleged patent infringements. But while the claim’s validity has yet to be proved or disproved, there are suggestions the lawsuit is merely revenge for TiVo suing AT&T.

To recap: TiVo is suing AT&T for allegedly using its timeshifting technology without permission as part of the U-Verse service. That service is largely powered by Microsoft software and makes AT&T the biggest customer for Microsoft in that field.

Now Microsoft is suing TiVo for allegedly copying Microsoft technologies for purchasing programming and displaying information, a claim TiVo says is merely designed as a strategy to help out AT&T.

If that’s true, it’s a good example of why people hold corporations and lawyers in contempt. If Microsoft thinks TiVo breached its patents, it should have sued the moment it came to that conclusion. If it’s simply bringing the case to stand up for a business buddy, Microsoft might as well open its courtroom appearance with the phrase, “I know you are, but what am I?”

    “it should have sued the moment it came to that conclusion”.

    When did suing become the accepted first point of action? Shouldn’t it be a last resort after both parties try to reach an agreement?
