You know, I’d say about a month ago, I got an email from someone saying Mike Portnoy was suing Dream Theater. I didn’t know how to go about uncovering this, since I’m fucking mad busy all the time burying dead cats, working, and writing posts for Gun Shy Assassin.
Now, Courthouse News Service has unearthed all the details involving the suit.
Portnoy, who is Dream Theater’s former drummer by his own choices, filed a lawsuit against his former bandmates in April claiming that they “wrongfully excluded” him from the group and continue to “wrongfully using the name of the band in connection with [their] recording of an album without the participation or consent of [Portnoy].”
The suit further alleges that Dream Theater “are wrongfully using the name of the band in connection with the promotion of live performances by the individual defendants, without the participation or consent of [Portnoy].”
What a bitch move, man! You leave the band, and then you sue them for carrying on? I don’t know how he expects to win this legal battle, considering he jumped ship for Avenged Sevenfold. But what do I know? I’m no lawyer. Maybe he has a case. I doubt it, but there’s a small chance.
